1. Interpretation and Definitions

“I/ we/our/us/Polly Cosmetics”: means Polly Cosmetics Limited.

“Customer/you/your”: means the person or entity to whom this document is addressed.

“Website”: means, www.pollycosmetics.com or any other subdomains of Polly Cosmetics Ltd., unless excluded by their own terms and conditions.

“Online Store”: means the method by which the customer uses and purchases any goods, products or services from Polly Cosmetics Ltd. 

“Order”: means the customer placing an order for products on the online store.

2. Overview

2.1 These Terms and Conditions apply in addition to our Privacy Policy and other legal policies and notices as displayed on our website.

2.2 By using any service of, or purchasing any goods from Polly Cosmetics Limited, you (the customer) agree to be bound by these Terms and Conditions. Any participation in our service will constitute acceptance of this agreement.

2.3 If you do not agree to abide by our Terms and Conditions, please do not use our website or online store.

2.4 We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time and without prior notice.

2.5 Our online store and website are designed for use by people aged 16 years and over. Please do not use the online store or our website if you are under this age.

2.6 We have no control over and assume no responsibility for, the content, privacy policies, or practices of any third-parties, their websites or services, who may advertise on our website.

3. Orders, Payments and Pricing

3.1 All goods and products purchased from our online store are to be paid for by the customer at the time of placing the order, in full and in advance of receiving the goods, service or product/s.

3.2 Payment for goods and product/s is to be made in GBP Sterling, through our website via credit/debit card, or PayPal. Please refer to our online store for the complete list of up-to-date payment methods.

3.3 All orders are subject to acceptance and availability. If ordered product/s and goods are not available, you will be notified by email. We will offer you the options of waiting until the item is available or cancelling your order.

3.4 Our prices are clearly noted on our product lists, relevant marketing materials and can be found on our website.

3.5 Prices for our goods and product/s may change from time to time, but changes will not affect any confirmed order.

3.6 The customer may be asked to supply certain information relevant to our service. This may include commercial, personal and financial data.

3.7 We are not VAT registered and our goods and products do not include VAT.

3.8 The customer is responsible for any additional fees incurred, such as and for example, financial transfer fees, import duties and taxes.

3.9 We accept no liability in the event that you provide an incorrect delivery address or where you fail to collect the goods and product/s from the specified delivery address.

3.9.1 Any person attempting to make fraudulent financial transactions will be prosecuted with no exception.

3.9.2 We do not tolerate or accept any charge-back threat or actual charge-back from the chosen payment method. In the event that a charge-back threat is made or is placed, we reserve the right to report the incident to relevant credit/financial agencies.

3.9.3 Our goods, services and product/s are not for re-sale or distribution, unless previously agreed in writing.

4. Delivery

4.1 We despatch all orders within 24-working hours of receiving and accepting Your order. Any products or goods that are unavailable at the time of your order will be dispatched as soon as possible and We will notify you.

4.2 We deliver internationally, subject to our discretion.

4.3 Generally, UK delivery is between Monday and Friday, between 8 AM and 6 PM. Precise delivery times may differ and depend on the size of the parcel and the delivery address.

4.4 Generally, for UK deliveries, your order will be delivered withing 3-5 working days of dispatch. Delivery to destinations outside of the UK can take anywhere between 5-30 days after dispatch. This is also subject to and dependant on any relevant customs’ processes within the destination country.

4.5 If delivery delays originate with the carrier or another third-party then we will notify you as soon as possible to let you know. As such, we will not be liable for this delay.

4.6 In the instance of a significant delivery delay, you will be entitled to receive a refund for any goods, services or products you have paid for, but not received.

4.7 Delivery to destinations outside of the UK may be subject to import duties and taxes. In this instance, the customer is responsible for any additional delivery fees incurred.

4.8 Delivery to destinations outside of the UK and particularly cross border shipments may be subject to inspection by customs and other relevant authorities. In this instance, we are not liable for any damage to packages, parcels and their contents.

4.9 As the importer of goods and products delivered to destinations outside of the UK, you must comply with the import laws, legislation and regulations of the recipient country.

4.9.1 If you wish to request an alternative delivery method, please do so by contacting us at the time of placing your order.

5. Returns and Refunds

5.1 You have the right to claim a refund, replacement, repair and/or compensation where the goods or products are faulty or misdescribed.

5.2 In the event that you receive product/s and goods that are broken, damaged or unfit for purpose, then you will be given a full refund or an exchange, depending on your preference. Please note, this excludes any damage caused by the carrier or third party, such as customs or relevant bodies.

5.3 If you wish to claim a refund or exchange, please return the unused goods and products to our returns address, with a copy of your receipt and a brief explanation of the issue, within 14 days of receipt.

5.4 We cannot take responsibility for the delivery time or loss of a returned package. Thus, we recommend using recorded post with tracking numbers to ensure your package is returned to us in a safely and timely manner.

5.5 We do not offer refunds or replacements if you:

5.5.1 Knew the products or goods were faulty when you made the purchase.

5.5.2 Received the product/s or goods free of charge or as part of a free offering, such as product testing or a competition.

5.5.3 Damaged the goods or product/s by trying to repair it.

5.5.4 No longer want or have changed your mind about the goods or product/s

5.6 We only accept returns from the person/customer who bought the item.

5.7 You are responsible for paying any return shipping fees and costs.

5.8 In some instances, we may ask you to prove that the product/s or goods were faulty when you bought them.

6. Free Services, Offers and Promotions

6.1 The conditions, (with the exception of clause 5) contained within our Terms and Conditions also apply to any free services, offers and promotions that we provide, including product testing and competitions.

6.2 We reserve the right to change, terminate, remove or suspend our free services, offers and promotions, at any time and without liability.

6.3 Any free service, offer and promotion is not transferable and is not subject to cash alternative/s.

6.4 Any free service, offer and promotion that has not been claimed within 30 days of the date of award/acceptance, becomes invalid.

6.5 You may only use one discount/promotional code with each order. We reserve the right to reject or cancel any orders where you add more than one discount code to the basket.

6.6 We allow you to use discount codes strictly on the terms and conditions upon which they were issued which, amongst other things, may include terms relating to your eligibility to use them and a maximum order value.

7. Liability

7.1 While we endeavour to keep the information on our website up to date and accurate, we make no representations or warranties of any kind. Express or implied, about the completeness, correctness, accuracy, reliability, safety, suitability, or availability with respect to the website or the information, products or services contained on the website for any purpose. Any reliance you place on such information is strictly at your own risk.

We make no assurances that the information contained within our website – and your interpretation of it – is applicable or appropriate to your particular situation.

If any section of these Terms and Conditions of Sale shall be unlawful, void, or for any reason unenforceable, then that section shall be deemed severable from this agreement and shall not affect the validity and enforceable of any remaining sections.

7.2 These Terms and Conditions are not transferable by the client to any third party.

7.3 In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from or in connection with, the use of our product/s, goods and services, our website and our online store, other than liability for death and personal injury caused by our negligence.

7.4 We are not liable for any allergic reactions to any ingredient contained within our products and goods. Please read our ingredients list carefully before you purchase our product/s and goods.

7.5 It is advisable to complete an allergy patch test before using new products. In case you experience a reaction, discard the product and discontinue its use.
